1. Scope of Services & Acceptance
Welcome to Fiktu and Fatkun, operated by AGINNOV TECHNOLOGY LIMITED ("Fiktu", "we", "us", or "our"). By registering an account, accessing the web workspace, installing our browser extensions, or using any of our AI visual and store management services, you agree to be bound by these Terms of Service.
Our platform provides cross-border e-commerce sourcing, structured product extraction, AI image translation and inpainting, AI studio generation, video localization, and multi-store listing automation across Coupang, Naver, Temu, Shopify, Ozon, Shopee, and other global marketplaces.
2. Account Registration & Security
You must provide accurate and complete registration information and maintain the confidentiality of your account credentials, API keys, and connected store authorization tokens.
- Accounts are for use by the registered entity or its authorized team members only. Unauthorized sharing, reselling, or automated credential abuse is strictly prohibited.
- You are solely responsible for all product collection, AI processing tasks, and store publishing actions executed under your account.
- Please notify us immediately at support@fiktu.com if you suspect any unauthorized access to your account.
3. Subscriptions, AI Credits & Billing
Fiktu operates on a transparent SaaS subscription (VIP Plans) and pay-as-you-go AI Credit system. Pricing and credit consumption rates for each AI capability are clearly displayed on our Pricing page (/pricing) and within each workbench before execution.
- Transparent Credit Deduction: Estimated credit consumption is displayed prior to launching batch AI translation, background removal, studio generation, or video tasks.
- Automatic Failure Protection: If an AI task fails due to system or upstream model provider errors, the deducted credits for that task are automatically refunded to your account balance.

4. Cross-Border Listings & Intellectual Property
Fiktu acts strictly as a neutral technical tool and SaaS workflow provider. We do not claim ownership over user-collected or user-uploaded product assets, nor do we pre-screen merchant listings for legal compliance.
- Merchant Rights Confirmation: Before exporting product packages or publishing listings to target marketplaces, you must ensure you hold valid authorization from the rights holders or comply with applicable intellectual property, trademark, portrait, and advertising laws.
- Prohibited Content: You may not use our services to collect, process, or list counterfeit goods, infringing materials, or items prohibited by target destination jurisdictions.
- Indemnification: You assume full legal responsibility for any third-party IP claims, marketplace penalties, or disputes arising from products published through your account.
5. Acceptable Use & Platform Integrity
To maintain enterprise-grade reliability (99.9% SLA) for all merchants, you agree not to:
- Reverse engineer, decompile, or attempt to bypass billing, authentication, or rate-limiting mechanisms of Fiktu Web or Fatkun Extensions.
- Launch automated scraping attacks, DDoS traffic, or abusive concurrent workloads that degrade platform queues.
- Upload malware, unlawful adult content, or materials that violate applicable international laws.
6. Disclaimer of Warranties & Limitation of Liability
To the maximum extent permitted by law, Fiktu provides its services on an "AS IS" and "AS AVAILABLE" basis. Due to changes in third-party source websites, marketplace API updates, and the probabilistic nature of generative AI models, we do not warrant that AI outputs will be error-free or guarantee specific commercial sales outcomes.
In no event shall AGINNOV TECHNOLOGY LIMITED be liable for any indirect, incidental, consequential, or punitive damages. Our aggregate liability shall not exceed the total amount paid by you to Fiktu during the twelve (12) months preceding the claim.
